This program is designed to address Contracts Best Practices, including actual court cases illustrating what can go wrong with a contract. This segment is designed to address controls accountants and auditors may want to review when assessing contractual risk. The session will include various sources of contract law and specific controls accountants and auditors may want to assess when evaluating contract content and management. The class will also discuss simple, effective, methods for managing the contractual process, from contract formation to termination.

This program will also address legal methods for protecting confidential Information that auditors and accountants should take into consideration when conducting at their work. The discussion will include measures for protecting work papers and issues regarding the use of "best evidence" for proving audit findings. The session will include illustrative court cases addressing work product and other privileges. Methods discussed may also be used in other parts of the organization in order to legally preserve confidentiality and related privileges.

James S. Fargason has two law degrees, including an advanced law degree in International and Comparative Law. He has been a member of the auditing and legal professions for over 15 years. Fargason is a CPA, and has been retained as a corporate trainer and expert in a variety of areas. Additionally, he has been engaged on numerous court cases to provide expertise in the areas of accounting and auditing. Fargason has extensive university experience and has also served on faculty at three nationally known research universities. He currently serves as a full-time faculty member for the MBA Program at Louisiana State University, which recently received a 7th place ranking by the Wall Street Journal. Over the years, he has taught a variety of subjects including internal auditing, financial accounting, managerial accounting, external auditing, fraud auditing, and cost accounting. Fargason has won seven teaching awards and has published numerous works in the areas of auditing and accounting.

Fargason has worked for a variety of reputable organizations including Deloitte, Brunswick, General Motors, Chase, the World Bank, Dow Chemical, Blue Cross & Blue Shield, LUBA Workers Compensation, IBM, and the Federal Reserve Bank. He has conducted audit and/or legal related services in California, New York, Texas, Louisiana, Georgia, Ohio, & Arizona. Fargason has lectured in Asia, Europe, North America, and Latin America to professionals in his field.
